Epic Games vs Apple Legal Battle to Head to In-Person Trial in May

Update 03/02/2021: Judge Yvonne Gonzalez Rogers has now set a May 3 in-person trial date for the Epic vs. Apple case. As reported by MacRumors, lawyers for both sides took part in a management conference with the judge, who plans to have all possible witnesses appear in-person in the Northern California court (with health considerations taken into account for those who cannot travel). The move has been deemed important enough that it should be heard in person. "When someone walks into the United States courthouse through courthouse doors and they sit on the stand and raise their right hand, it gives them pause," Judge Gonzalez Rogers said, per Law360. "That's really different than sitting in the comfort of your house or comfort of your office, and cross-examination is different." Judge Gonzalez Rogershas stressed that health precautions will be taken in the courtroom, with details to be finalised in the run-up to May 3. "We're still working on precise format. Worst-case scenario is a full bench trial by Zoom, but it will happen," she said. Judge Yvonne Gonzalez Rogers explained that she would not accept Apple's claims of theft from Epic, and would not award monetary damages beyond those of the breach-of-contract case the companies are embroiled in. ”This is a high-stakes breach of contract case and an antitrust case and that’s all in my view,” the judge explained, per Bloomberg. ”You can’t just say it’s independently wrongful,” she told Apple's lawyer. “You actually have to have facts.” The case will continue as a breach-of-contract dispute, and will begin in earnest in May 2021. [poilib element="accentDivider"] Update: Last Friday, Judge Yvonne Gonzalez Rogers has granted Epic's injunction, preventing Apple from removing Epic's developer account and denying iOS developers access to the Unreal Engine. However, Gonzalez Rogers also ruled that Apple is allowed to keep Fortnite off the App Store. Citing the magnitude of the case, the Judge presiding over the ongoing Apple vs. Epic legal case has stopped Apple from terminating Epic's developer account, which would prevent the company from releasing updates for the Unreal Engine on iOS. However, Fortnite will remain banned on iOS. A court date has been scheduled for Summer 2021 which will hopefully determine an outcome for the trial. While it's unclear where the court stands on the legal fight between Epic and Apple, Gonzalez Rogers wrote in their injunction grant "Epic Games has strong arguments regarding Apple's exclusive distribution through the iOS App Store, and the in-app purchase ("IAP") system through which Apple takes 30% of certain IAP payments." But they added, "However, given the limited record, Epic Games has not sufficiently addressed Apple's counter-arguments." A hearing will take place today, September 28, with U.S. District Judge Yvonne Gonzalez Rogers in place to make the decision. Public opinion seems largely on Epic's side as the company is seen to be challenging the status quo, but that's no indication as to where the judge will draw the line. Naturally, Apple did not take kindly to this, and so the company removed Fortnite from the App Store. In response, Epic filed a lawsuit against Apple. It also began the #FreeFortnite hastag, along with an in-game event that featured a parody of the Apple 1984 commercial. Many saw these tactics as Epic weaponising its fans to hold sway against Apple. Despite requests from Epic, the courts ruled that Apple did not have to reinstate Fortnite on the App Store, which further damaged Epic's fortunes. Epic quickly submitted a second request to be reinstates after reporting that daily active users of Fortnite on iOS was down over 60%. The fate of this feud now lies with U.S. District Judge Yvonne Gonzalez Rogers, who will make a decision based on today's hearing of the Preliminary Injunction, which begins at 9:30am. The Trap: NFL Star Lance Briggs Makes His Comic Book Debut

Former NFL star Lance Briggs is making the jump to comic book writing. Briggs has teamed with co-writer Kyle Higgins (Nightwing) and artist Danilo Beyruth (Man Without Fear: The Death of Daredevil) to create The Trap, a full-length graphic novel inspired by Briggs' own struggle to make it in the world of professional sports. The Trap is a futuristic science fiction story about an aspiring sports star named Jaylen Robinson. Jaylen has the potential to make it big playing the galaxy's favorite pastime, surfriding, but that career is thrown in jeopardy strikes when the cash-strapped athlete steals a senator's car and accidentally shoots him. The creative team also includes colorist Tamra Bonvillain, letterer Hassan Otsmane-Elhaou and designer Sasha Head. No Time To Die: Official James Bond Podcast Launching on September 30

No Time To Die: The Official James Bond Podcast is launching on September 30 ahead of the worldwide release of the 25th Bond film this November. The official 007 Instagram account shared a short video teaser for the new podcast, which will feature exclusive interviews with Daniel Craig, Rami Malek, Léa Seydoux, Lashana Lynch, Jeffrey Wright, Naomie Harris, director Cary Joji Fukunaga, producers Michael G. Wilson and Barbara Broccoli and a host of key crew members, including the film's casting director and special effects supervisor. The six-part series, hosted by film critic James King, will give listeners "unrivalled behind-the-scenes access" to the next Bond film. Each episode will focus on a different aspect of the franchise, giving fans the opportunity to learn more about everything that goes into the making of the iconic film series, from the guns and gadgets to the locations, stunts, costumes and cars. In addition to all of this top-secret intel, Yahoo reports that the podcast will feature "the first listen to Hans Zimmer's score for the film with brand new recordings from the Royal Philharmonic Orchestra." Pokemon Sword and Shield: New Info on The Crown Tundra DLC Arriving Tomorrow

New information on Pokemon Sword and Shield's The Crown Tundra DLC will be revealed tomorrow, September 29, 2020, at 6am PT/9am ET/2pm BST. Pokemon announced the news on Twitter, but gave no further information besides saying "Get Ready, Trainers: we've got updates on #PokemonSwordShieldEX!" The image accompanying the tweet does also feature The Isle of Armor logo, so there may be more updates in store for Pokemon Sword and Shield's first expansion as well, even though it was released a few months ago. Like a Dragon is now set to launch on Xbox Series X and S, PS4, and PC on November 10. This date is a slight adjustment from the previously announced November 13 launch date, but that date came with an asterisk, as Yakuza has been planned as an Xbox Series launch game before Xbox's next-gen consoles were given a release date. Now, it will hit both Xbox's next-gen systems and current-gen hardware, as well as PC, on the same day. Disney’s Live-Action Peter Pan Movie Has Found Its Tinker Bell

Grown-ish actress Yara Shahidi has been cast as Tinker Bell in Disney's live-action Peter Pan movie, Peter Pan and Wendy. Deadline reports that Shahidi, who is best known for playing Zoey Johnson in Black-ish and its spin-off series Grown-ish, is set to sprinkle pixie dust over herself to transform into the tinker-talented fairy from Peter Pan for the studio's latest live-action adaptation of J.M. Barrie's classic tale. Shahidi will be the first woman of colour to take on the iconic role of the character, previously assumed by Julia Roberts in 1991's Hook and Ludivine Sagnier in 2003's Peter Pan. Shahidi celebrated the casting announcement on Instagram where she posted an illustration of herself as Tinker Bell. In the caption of the post, Shahidi credited the Instagram account @alexcollectsofficial for the artwork, writing: "Thank you for all of the love. It, truly, means so much to me. I'm excited for this next adventure!" Several stars joined in with the celebration, including Halle Bailey who was cast to play Ariel in Disney's live-action version of The Little Mermaid earlier this year. Shahidi celebrated the casting announcement on Instagram where she posted an illustration of herself as Tinker Bell. In the caption of the post, Shahidi credited the Instagram account @alexcollectsofficial for the artwork, writing: "Thank you for all of the love. It, truly, means so much to me. I'm excited for this next adventure!" Several stars joined in with the celebration, including Halle Bailey who was cast to play Ariel in Disney's live-action version of The Little Mermaid earlier this year. Lowery and Halbrooks previously worked together on Disney's live-action remake of Pete's Dragon, which fared well with critics and audiences upon its release in 2016. IGN's review of the movie praised the script for "taking cues from the original but reimagining the story for a very different audience living in a very different era," with a "great cast, a believable dragon and beautiful cinematography."
